Last Will and Testament of Charles J. Trost, Jr.
I, CHARLES J. TROST, JR. of Chicago, Illinois, declare this to be my last will and revoke all other wills and codicils that I may have made.
Article I. I direct that my debts, expenses of my last illness, funeral and the administration of my estate, shall be paid by my executor from the principal of my residuary estate.
Article II. All inheritance, estate and succession taxes (including interest and penalties thereon) payable by reason of my death shall be paid out of and be charged generally against the principal of my residuary estate without reimbursement from any person.
Article III. I devise and bequeath all my residuary estate, being all property, wherever situated, in which I may have any interest at the time of my death not otherwise effectively disposed of, but not including any property over which I may have power of appointment as follows:
1.     To my wife, MARGARET M. TROST, if she survive me.
2.     If my wife does not survive me, to my descendants who survive me, per stirpes. At the present time my descendants who would take under this provision are my children, all of whom are adults:

Josephine Allen of Indianhead Park, Illinois, and
James M. Trost of Chicago, Illinois.

If my wife and I shall die simultaneously under circumstances that render it difficult to determine which of use died first, it shall be deemed that she survived me. If any other legatee under this will and I should die simultaneously or under circumstances that render it difficult to determine which of us died first, it shall be deemed that such legatee did not survive me.
Article IV. If any beneficiary of mine has not attained legal age at the time any property becomes distributable to him or her, the executor may distribute any part of all of such property to a parent or adult relative of the beneficiary, as trustee, against such person's receipt and upon his written undertaking to deliver the property to the beneficiary at the time he or she attains legal age, and in the meantime to hold it in trust and use it for the benefit of the beneficiary. Such receipt and written undertaking shall discharge the executor.
Article V. 1. I appoint my wife, MARGARET M. TROST, as executor of this will with the following powers, and any others that may be granted by law, to be exercised in her discretion without court order:
(a)     To retain any property of my estate;
(b)     To sell any real or personal property of my estate for cash or on credit, at public or private sales, for any purpose; to exchange any such property for other property; to grant options to purchase or acquire any such property; and to determine the prices and terms of sales, exchanges and options;
(c)     To employ attorneys, auditors, depositaries, proxies and agents, with or without discretionary powers; and to keep any property in the name of an executor or a nominee, with or without disclosure of any fiduciary relationship, or in bearer form;
(d)     To collect, pay, contest, compromise or abandon claims of or against my estate, wherever situated; and to execute contracts, conveyances and other instruments containing covenants and warranties binding upon and creating a charge against my estate, and containing provisions excluding personal liability;
(e)     To enter into any transaction authorized by this Article with trustees, executors or administrators of any other trust or estate in which any beneficiary hereunder has any interest, even though any such trustee or representative is also executor hereunder.
(f)     To make any distribution or division of my estate in cash or in kind or both;
(g)     To allot different kinds or disproportionate shares of property or undivided interests in property among the beneficiaries, and to determine the value of any such property;
(h)     To invest in any property, real or personal.
2. In the even of the death, resignation, failure or refusal of my wife, MARGARET M. TROST, to act as executor, I appoint my daughter MARIALICE McCARTHY as successor executor of this my last will and testament. In the event of the death, resignation, failure or refusal of my daughter to act as executor, I appoint my son JAMES M. TROST as executor. Any successor executor herein named shall have any may exercise all of the powers granted to my first executor herein named.
3. I direct that surety on the executor's bond of my wife, MARGARET M. TROST, my daughter MARIALICE McCARTHY and my son JAMES M. TROST, or on the bond of any of my other children who may be appointed as administrator de bonis non with the will annexed be waived and that they be permitted to act as such executor or administrator without surety on their bonds.

I have signed and sealed this will on this 19 day of January 1978.

We saw CHARLES J. TROST, JR., in our presence sign and seal the foregoing instrument at its end; he then declared it to be his last will and requested us to act as witnesses to it; we believe him to be of sound mind and memory and not under duress or constraint of any kind; and then we, in his presence and in the presence of each other, signed our names as attesting witnesses; all of which was done on the date last above written in said instrument.
