Last Will and Testament of Charles J. Trost, Jr.
I, CHARLES J. TROST, JR. of Chicago, Illinois, declare this to be my last will and revoke all other wills and codicils that I may have made.
Article I. I direct that my debts, expenses of my last illness, funeral and the administration of my estate, shall be paid by my executor from the principal of my residuary estate.
Article II. All inheritance, estate and succession taxes (including interest and penalties thereon) payable by reason of my death shall be paid out of and be charged generally against the principal of my residuary estate without reimbursement from any person.
Article III. I devise and bequeath all my residuary estate, being all property, wherever situated, in which I may have any interest at the time of my death not otherwise effectively disposed of, but not including any property over which I may have power of appointment as follows:
1.     To my wife, MARGARET M. TROST, if she survive me.
2.     If my wife does not survive me, to my descendants who survive me, per stirpes. At the present time my descendants who would take under this provision are my children, all of whom are adults:

Charleen Skupien of Schiller Park, Illinois,
Josephine Allen of Indianhead Park, Illinois, and
James M. Trost of Chicago, Illinois.

If my wife and I shall die simultaneously under circumstances that render it difficult to determine which of use died first, it shall be deemed that she survived me. If any other legatee under this will and I should die simultaneously or under circumstances that render it difficult to determine which of us died first, it shall be deemed that such legatee did not survive me.
Article IV. If any beneficiary of mine has not attained legal age at the time any property becomes distributable to him or her, the executor may distribute any part of all of such property to a parent or adult relative of the beneficiary, as trustee, against such person's receipt and upon his written undertaking to deliver the property to the beneficiary at the time he or she attains legal age, and in the meantime to hold it in trust and use it for the benefit of the beneficiary. Such receipt and written undertaking shall discharge the executor.
Article V. 1. I appoint my wife, MARGARET M. TROST, as executor of this will with the following powers, and any others that may be granted by law, to be exercised in her discretion without court order:
(a)     To retain any property of my estate;
(b)     To sell any real or personal property of my estate for cash or on credit, at public or private sales, for any purpose; to exchange any such property for other property; to grant options to purchase or acquire any such property; and to determine the prices and terms of sales, exchanges and options;
(c)     To employ attorneys, auditors, depositaries, proxies and agents, with or without discretionary powers; and to keep any property in the name of an executor or a nominee, with or without disclosure of any fiduciary relationship, or in bearer form;
(d)     To collect, pay, contest, compromise or abandon claims of or against my estate, wherever situated; and to execute contracts, conveyances and other instruments containing covenants and warranties binding upon and creating a charge against my estate, and containing provisions excluding personal liability;
(e)     To enter into any transaction authorized by this Article with trustees, executors or administrators of any other trust or estate in which any beneficiary hereunder has any interest, even though any such trustee or representative is also executor hereunder.
(f)     To make any distribution or division of my estate in cash or in kind or both;
(g)     To allot different kinds or disproportionate shares of property or undivided interests in property among the beneficiaries, and to determine the value of any such property;
(h)     To invest in any property, real or personal.
2. In the even of the death, resignation, failure or refusal of my wife, MARGARET M. TROST, to act as executor, I appoint my daughter MARIALICE McCARTHY as successor executor of this my last will and testament. In the event of the death, resignation, failure or refusal of my daughter to act as executor, I appoint my son JAMES M. TROST as executor. Any successor executor herein named shall have any may exercise all of the powers granted to my first executor herein named.
3. I direct that surety on the executor's bond of my wife, MARGARET M. TROST, my daughter MARIALICE McCARTHY and my son JAMES M. TROST, or on the bond of any of my other children who may be appointed as administrator de bonis non with the will annexed be waived and that they be permitted to act as such executor or administrator without surety on their bonds.

I have signed and sealed this will on this 19 day of January 1978.

TROST, JR., in our presence sign and seal the foregoing instrument at its end; he then declared it to be his last will and requested us to act as witnesses to it; we believe him to be of sound mind and memory and not under duress or constraint of any kind; and then we, in his presence and in the presence of each other, signed our names as attesting witnesses; all of which was done on the date last above written in said instrument.

Anecdote*The following is an account of Charles and Margaret's honeymoon taken from Margaret's diary.
     6-24-39 - Was married at 9:00 A.M. Saturday June 24th at Out Lady of Mercy Church, 4432 North Troy Street. Had breakfast at the Soverign Hotel. Took several pictures including a 100 ft. 16 MM colored film in front of the Church, the yard at home and coming out of the Hotel. Reception at home--many friends came and we left at 10:00 P.M. for the Stevens Hotel on Michigan Avenue. Stayed in room 1202A.
     6-25-39 - Went to 12:00 o'clock Mass at St. Mary's Church on 9th and Wabash. Left at 1:00 P.M. for St. Louis arriving at 10:15 P.M. A slow trip--too much traffic. Stayed at the Northwestern Hotel--Room 330.
     6-26-39 - Went out to see my sister Regina at Marillac Seminary in Normandy, Missouri. Had lunch there and took Sister Regina and Sister Mary Genevieve to see Grandma Hanratty in the afternoon. That evening went to see Coraestell and John Simon. They took us for a drive around the city for a couple of hours and then went back to have some cornbeef sandwiches and beer. Went back to the same hotel. (Very warm in St. Louis.)
     6-27-39 - Slept until noon and went to see Sister Regina at 3:00 P.M. and visited with her until 5:30. Left St. Louis at 7:00 P.M. and stopped at Carrollton, Illinois for supper. Arrived in Jacksonville, Illinois at 9:00 P.M. (rain) Stayed at the Douglas Hotel, Room 202. (Very hot--left fan going all night.)
     6-28-39 - Left Jacksonville at 9:00 A.M. and ate dinner at LaSalle, Illinois at 1:00 P.M. Saw bridge over Illinois river being lifter. (More rain today) Arrived in in Delavan, Wis. At 5:45 P.M. Stayed at a Tourist Home on 7th and Walworth. Took a walk around the town and then listened to the Louis-Galento fight--Louis won.
     6-29-39 - Left Delavan at 9:30 A.M. Stopped at Fond Du Lac at 1:00 P.M. for dinner. Charles smoked a cigarette at 5:20 P.M.--Did not smoke for 7 days. Arrived in Michigan at 5:25 P.M. Stopped at Tourist Home in Menominee, Mich. on 1st and Ogden Sts. Took a walk and arrived back at the Home just before a rainstorm.
     6-30-39 - Left at 1:30 P.M. and took route M35 along Green Bay to Escanaba arriving at 3:25 P.M. Went on to Gladstone and went to Novena of the Sorrowful Mother at 7:00 P.M. Stayed at tourist home in Gladstone.
     7-1-39 - Left Gladstone at 9:00 A.M. and took ferry at 1:00 P.M. from St. Ignace to Mackinaw City arriving at 2:00 P.M. Stayed at Tourist Home on Scyamore she and 4th. Took a walk around town and bought some souvenirs.
     7-2-39 - Went to St. Mary's Church for 8:30 Mass and left at 10:00 A.M. Bought a windmill in Holland, Michigan for Pops Trost. Ate dinner in Fennville at 2:00 P.M. and went to Bodine's farm arriving at 2:30 P.M. Joe O'Neill and Francis Trost were there but were out fishing with Mr. Bodine. They returned home at 4:00 P.M. and we ate again. Took pictures and went to Fennville later for beer. Came back to the farm and got dressed and went out to Saugatuck. Stayed at the farm that night.
     7-3-39 - Got up at 11:30 A.M. Had breakfast and went to Ely Lake in the afternoon. Joe O'Neill and Francis Trost went swimming. Stopped for beer and went back to Farm. Ate the fish Joe and Francis caught the day before. Left at 9:45 P.M. for Chicago. Arrived Home at 2:00 A.M.15
